Martial Law?

I read somewhere on Facebook, and everyone knows you can't put anything on the Internet that isn't true, that the Boston Bomber is going to be arrested and interrogated as an enemy combatant. That part I know is true and okay with, BUT!!!.... because an enemy combatant acted on, and was arrested on American soil, the POTUS has the will, ability, and incinitive to declare Martial Law. Someone please tell me that isn't true.

I'm sure he can, but from what I've read they are trying him as an American, and they should.
Each and everytime a POTUS has suspended Habeas Corpus ( Lincoln & Grant for example...) it has been

found to be unconstitutional because it is written into the US Constitution...

"The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion, the public safety may require it." Section 9 is under Article 1 which states, "legislative Powers herein granted shall be vested in the Congress of the United States..."

Therefore...only Congress ( after debating and voting on it ) can suspend it (and only in the case of open rebellion or invasion)
Is there not a provision in the Patriot Act that allows them to suspend constitutional rights?
